Reviews Shipping policy Shipping & Delivery Policy This Shipping & Delivery Policy forms part of our Terms & Conditions of Sale and should be read together with them and with our Returns, Exchanges & Refunds Policy. Where there is any conflict between this policy and our Terms & Conditions of Sale, the Terms & Conditions of Sale take priority. Words defined in the Terms & Conditions of Sale have the same meaning in this policy. Nothing in this policy limits or excludes any statutory rights you may have under applicable consumer protection law. 1. Information About Us We operate www.allbirds.co.uk and related properties (the "Website"). We are GJH London Limited, a company registered in England and Wales under company number 17330860, with our registered office at 7 Savoy Court, London WC2R 0EX, United Kingdom ("Allbirds", "we", "us", "our"). To contact us about an order or delivery, please email [email protected] or call +1 424 644 1644. 2. Where We Deliver 2.1 We currently accept orders for delivery to eligible addresses within the United Kingdom, the Channel Islands and the Isle of Man. We do not deliver to other destinations through the Website unless otherwise indicated at checkout. 2.2 Delivery to certain remote or rural areas, including parts of the Scottish Highlands and Islands, Northern Ireland and offshore territories, may take longer than the delivery estimates stated in this policy. Certain delivery services may also be unavailable to some postcodes. 2.3 To the extent permitted by applicable law, we may decline or cancel orders placed for delivery to PO Boxes, BFPO addresses, parcel or freight forwarding services, or addresses that we reasonably believe present a fraud, security, safety or delivery risk. If we cancel an order after payment has been received, we will refund the amount paid for the affected order to the original payment method. 2.4 If we are unable to deliver to the address you have provided, we will contact you where reasonably possible and provide any refund or other remedy required under applicable law. 3. Fulfilment and Carriers 3.1 Orders may be picked, packed and dispatched by third-party fulfilment partners and delivered by third-party carriers acting on our behalf. 3.2 We may select the fulfilment location, carrier, delivery route and delivery method used to complete your order. Orders may be dispatched from one or more of our fulfilment centres or retail stores and may be split into multiple shipments. 3.3 We may use a different carrier from the carrier identified at checkout or in your confirmation email where reasonably necessary, provided that the substituted service is of a broadly equivalent standard and does not materially reduce the delivery service you selected or affect your statutory rights. 4. Order Processing 4.1 Orders are processed on business days. For the purposes of this policy, a "business day" means Monday to Friday, excluding public and bank holidays in England and Wales. 4.2 Orders placed after 2pm, or on a day that is not a business day, may be treated as received on the next business day for the purposes of processing and calculating applicable delivery estimates. 4.3 We aim to process and dispatch orders as quickly as reasonably possible. Processing may take longer during peak trading periods, promotional or sale events, product launches, stock takes, periods of unusually high order volume, or while payment authorisation, address verification or fraud screening is being completed. 4.4 An order acknowledgement does not constitute acceptance of your order. The Contract between you and us is formed as described in our Terms & Conditions of Sale. 4.5 Once your order has been dispatched, we will normally send you a shipping confirmation email containing tracking information where available. 5. Delivery Services, Charges and Estimated Timescales 5.1 The delivery services and charges currently available are: Standard Delivery Estimated delivery time: 1–5 business days. Orders under £45.00: £4.95 Orders of £45.00 or more: FREE 5.2 Available delivery services and charges are displayed at checkout before you place your order and may vary depending on your delivery address, order value and the Products in your order. Delivery charges displayed at checkout are inclusive of VAT where VAT is applicable. 5.3 The delivery estimates above are calculated from the date your order is treated as received under clause 4.2, unless a different timeframe is expressly displayed at checkout. 5.4 Delivery times are estimates only unless we have expressly agreed a guaranteed delivery date with you. Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier disruption, severe weather, public holidays, unusually high order volumes, customs delays or other events described in clause 12. 5.5 We may change our delivery services, charges, delivery thresholds and estimated timescales from time to time. The delivery options and charges that apply to your order are those displayed at checkout when you place your order. 5.6 Nothing in this policy affects your statutory rights. Unless we have agreed otherwise with you, we will deliver your order without undue delay and in any event within 30 days of the date on which the Contract is formed. If we fail to deliver within that period, you may have the right to specify an additional reasonable period for delivery and, if we still fail to deliver, to cancel the Contract and receive a refund. Where delivery within a particular period was expressly agreed as essential before the Contract was formed, or where it was clear from the circumstances that delivery by a particular time was essential, you may have additional rights under applicable law. 6. Delivery Address and Customer Responsibilities 6.1 You are responsible for providing a complete, accurate and up-to-date delivery address, telephone number and email address when placing your order. You are also responsible for providing any information reasonably required to complete delivery, including apartment or unit numbers, entry codes, concierge or reception details and relevant access restrictions. 6.2 If you notice an error in your delivery information, please contact us as soon as possible. We cannot guarantee that an address can be changed once an order has entered processing or has been dispatched. 6.3 Once an order has been dispatched, any redirection, redelivery, delivery hold, nominated safe place or other delivery instruction that you arrange directly with the carrier may be subject to the carrier's own terms. 6.4 Where delivery is delayed or cannot be completed because you have provided an incorrect or incomplete address, have failed to provide necessary access information, have failed to collect a parcel within the carrier's collection period, or have otherwise prevented delivery, we may take reasonable steps to recover the parcel and arrange an appropriate resolution. This does not affect your statutory rights. 7. Completion of Delivery, Risk and Ownership 7.1 Delivery is completed when the goods come into your physical possession or into the physical possession of a person you have identified to receive the goods on your behalf. 7.2 Risk in the goods remains with us until delivery has been completed in accordance with clause 7.1, except where applicable law provides otherwise. You own the goods once we have received payment in full, including any applicable delivery charges. 7.3 Where you nominate another person, neighbour, reception desk, concierge or other authorised recipient to accept the goods on your behalf, delivery to that person will constitute delivery to you. 7.4 If you instruct us or the carrier to leave your parcel in a nominated safe place, with a nominated neighbour or in another location specified by you, delivery may be completed when the goods are left in accordance with that instruction, to the extent permitted by applicable law. 7.5 Where your order is delivered to a collection point, parcel shop, locker or other third-party collection location selected or authorised by you, you are responsible for collecting the order within the collection period specified by the applicable operator. 8. Failed, Refused, Unclaimed and Returned Parcels 8.1 If delivery cannot be completed, the carrier may attempt delivery again, leave a delivery notice, send you an electronic notification or take the parcel to a local collection point. 8.2 If a parcel is refused, is not collected within the carrier's stated collection period or is otherwise undeliverable, it may be returned to us. 8.3 Once a returned parcel has been received and processed by us, we will refund the price of the returned goods to the original payment method, subject to our Terms & Conditions of Sale and Returns, Exchanges & Refunds Policy. Where you have exercised a statutory right to cancel your order, any refund of the original delivery charge will be handled in accordance with applicable law and our Terms & Conditions of Sale. In other circumstances, original delivery charges may be non-refundable unless otherwise required by applicable law. 8.4 Where a customer repeatedly refuses deliveries, repeatedly fails to collect parcels or otherwise engages in activity that we reasonably believe to be fraudulent, abusive or excessive, we reserve the right, to the extent permitted by applicable law, to restrict future purchases, cancel orders or take other reasonable action in accordance with our Terms & Conditions of Sale and Returns, Exchanges & Refunds Policy. 9. Lost, Delayed, Damaged or Missing Items 9.1 Please check your parcel and its contents after delivery. 9.2 If an item arrives damaged, an item is missing from your parcel or you believe that your parcel has not been delivered, please contact us as soon as reasonably possible at [email protected] . We recommend reporting damaged or missing items within 14 days of delivery and parcels believed to be lost within 30 days of the estimated delivery date so that we can investigate with the applicable carrier. These reporting periods do not limit your statutory rights. 9.3 To investigate a delivery issue, we may reasonably ask you to provide information such as: Photographs of the goods, outer packaging and shipping label Confirmation of the delivery address A written statement confirming that the goods were not received Confirmation that you have checked with members of your household, neighbours, building management, reception areas and any nominated safe place Reasonable evidence of your identity or address where necessary to investigate potential fraud 9.4 Where a carrier investigation is required, we may need to wait for the carrier to complete its investigation before confirming an appropriate resolution. Carrier investigations for UK deliveries will normally be completed within approximately 10 business days, although some investigations may take longer. 9.5 Where tracking indicates that a parcel has been delivered, we may investigate the circumstances of delivery before issuing a replacement or refund. The outcome will take into account the carrier's delivery information, any delivery instructions provided and your statutory rights. 9.6 Where we reasonably determine that a claim is fraudulent or forms part of a pattern of excessive or abusive claims, we may decline the claim to the extent permitted by applicable law and may take the steps described in clause 8.4. 10. Multiple Items, Split Shipments and Product Availability 10.1 Orders containing more than one item may be dispatched in more than one parcel, from more than one fulfilment location and may arrive on different days. You will not be charged an additional delivery fee where we choose to split your order into multiple shipments. 10.2 If an item becomes unavailable after you place your order, we may cancel the affected item and refund the amount you paid for that item in accordance with our Terms & Conditions of Sale. 10.3 Products offered on pre-order or backorder may have estimated release, dispatch or delivery dates. Unless expressly stated otherwise, these dates are estimates only and may change. 11. Taxes, Duties and Import Charges 11.1 For eligible deliveries within the United Kingdom and the Isle of Man, prices include UK VAT where VAT is chargeable and no additional import charges will normally apply. 11.2 The Channel Islands have separate VAT and customs arrangements. Deliveries to the Channel Islands may be subject to local import duties, goods and services taxes, customs clearance fees or carrier handling charges. Where such charges apply, they may be payable by you in addition to the amount paid to us. These charges are imposed by the applicable local authority or delivery provider, and we do not control their amount. 11.3 If you refuse to pay an applicable import or customs charge and the parcel is subsequently returned to us, the returned parcel will be handled in accordance with clause 8. 12. Events Outside Our Control 12.1 We are not responsible for a failure or delay in performing our delivery obligations where that failure or delay is caused by circumstances outside our reasonable control, except to the extent that applicable law provides otherwise. 12.2 Circumstances outside our reasonable control may include: Disruption, capacity constraints, depot closures or service suspensions affecting fulfilment partners or carriers Postal or carrier delays Strikes, lockouts or other industrial action Severe weather, storms, flooding, fire or other natural disasters Epidemics or public health emergencies War, civil unrest or terrorism Closure or disruption of roads, ports, airports, rail networks or airspace Customs or border delays Fuel shortages Cyberattacks Failure or disruption of telecommunications, utilities or IT systems 12.3 Where an event outside our control materially affects delivery of your order, we will take reasonable steps to minimise the delay and provide updated information where reasonably possible. If an extended delay gives you a statutory right to cancel your order, nothing in this clause limits that right. 13. Our Liability in Connection With Delivery 13.1 Nothing in this policy excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors, fraud or fraudulent misrepresentation, defective products where liability cannot lawfully be excluded, or breach of your statutory rights relating to the goods. 13.2 If we fail to comply with this policy, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or negligence. We are not responsible for loss or damage that is not foreseeable, except where applicable law provides otherwise. 13.3 Products sold through the Website are intended for domestic and private use. Our policies relating to resale, commercial purchasing and abusive purchasing activity are set out in our Terms & Conditions of Sale and Returns, Exchanges & Refunds Policy. 13.4 Unless we have expressly agreed a guaranteed delivery date, delivery dates and timescales are estimates. Nothing in this clause excludes or restricts any right or remedy available to you under applicable consumer law where delivery is delayed. 13.5 Where you independently arrange a redirection, forwarding service, nominated safe place or other third-party delivery arrangement, our responsibility for events occurring after delivery will be determined in accordance with applicable law and the circumstances of the delivery. 14. Forwarding Services and Third-Party Delivery Arrangements 14.1 If you arrange for your order to be delivered to a parcel forwarding service, freight forwarder, mailbox, shipping agent or other third-party forwarding provider, you enter into a separate arrangement with that provider under its own terms. The forwarding provider is not our agent or subcontractor unless we have specifically appointed that provider. 14.2 To the extent permitted by applicable law, we are not responsible for loss, theft, damage, delay, misdelivery, seizure, customs charges or other costs arising from transportation or handling arranged independently by you after the goods have been delivered to your nominated forwarding provider. 14.3 If you arrange for goods to be forwarded or onward shipped outside the United Kingdom, the Channel Islands or the Isle of Man, you are responsible for arranging and paying for any onward transportation and for returning the goods to an eligible returns location where a return is permitted. We are not responsible for additional costs, taxes, duties, loss or damage resulting from independently arranged onward shipment. Nothing in this clause affects your statutory rights. 15. Changes to This Policy We may revise this policy from time to time to reflect changes to our delivery services, charges, carriers, fulfilment arrangements, applicable laws or regulatory requirements, or for security, technical or operational reasons. The version of this policy in force at the time you place your order will apply to that order. 16. Contact Us If you have any questions about delivery or experience a problem with an order, please contact us: Email: [email protected] Phone: +1 424 644 1644 Address: GJH London Limited 7 Savoy Court London WC2R 0EX United Kingdom 17. Governing Law This policy, its subject matter and its formation are governed by English law. If you are a consumer resident in another jurisdiction, you will continue to benefit from any mandatory consumer protections and legal rights available to you under the laws applicable to you, and nothing in this policy affects your right to rely on those protections. You and we agree that the courts of England and Wales will have non-exclusive jurisdiction.
